BOOKING POLICY

Tickets cannot be exchanged or refunded after purchase unless the event is cancelled. In the event of cancellation or rescheduling, organisers will inform ticket holders promptly and provide clear options for refunds or exchanges. Consumers have the right to a full refund if the event is cancelled, except in specific circumstances outlined in the terms and conditions. All tickets are valid to the name of the customer on the booking only. ID will be required on arrival at the event to release your entry wristbands. Name changes can be made for a fee, see clause 13.

TERMS AND CONDITIONS OF SALE (the “Conditions”)

1 INTERPRETATION
The following definitions and rules of interpretation apply in these Conditions.
1.1 Definitions:
‘Business Day’ a day other than a Saturday, Sunday or public holiday in Cyprus, when banks in Cyprus are open for business.
‘Charges’ the charges payable by the Customer for the supply of the Services in accordance with clause 4.
‘Contract’ the contract between the Supplier and the Customer for the supply of Services in accordance with these terms and conditions.
‘Controller, processor, data subject, personal data, personal data breach, processing and appropriate technical measures’ as defined in the Data Protection Legislation.
‘Customer’ the person who purchases Services from the Supplier; “you”.
‘Data Protection Legislation’ all applicable data protection and privacy legislation in force from time to time in Cyprus, including the General Data Protection Regulation ((EU) 2016/679) and any local implementation applicable in Cyprus.
‘Front Sheet’ the front sheet to these Conditions setting out details of the Supplier.
‘Intellectual Property Rights’ all intellectual property rights whether registered or unregistered, including all applications and rights to apply for such rights.
‘Services’ the experiences, events, goods and services made available by the Supplier to the Customer on the Website or otherwise provided by the Supplier to the Customer.
‘Supplier’ the supplier of the Services, with details set out in the Front Sheet; “we” or “us”.
‘Website’ means the Supplier’s ecommerce site which is hosted by the Platform Provider.
1.2 Interpretation:
1.2.1 A reference to a statute or statutory provision is a reference to it as amended or re-enacted.
1.2.2 Unless the context otherwise requires, any reference to European Union law that is directly applicable or directly effective in Cyprus at any time is a reference to it as it applies in Cyprus from time to time.
1.2.3 Any words following the terms including, include, in particular, for example or any similar expression, shall be construed as illustrative and shall not limit the preceding terms.
1.2.4 A reference to writing or written includes fax and email.

2 CONTRACT FOR SERVICES
2.1 The booking constitutes an offer by the Customer to purchase Services in accordance with these Conditions.
2.2 These Conditions apply to all bookings you make with us.
2.3 The booking shall only be deemed accepted when we issue a Booking Confirmation.
2.4 These Conditions exclude any other terms that the Customer seeks to impose or incorporate.
2.5 A quotation does not constitute an offer.
2.6 Our Website is operated by Boofie LTD. Any bookings made on the Website form a contract between you and Boofie LTD directly. All queries must be directed to us.
2.6.1 Your statutory rights as a consumer remain unaffected.

3 CUSTOMER’S OBLIGATIONS
3.1 The Customer shall:
• Ensure booking details and provided information are complete and accurate;
• Co-operate with the Supplier;
• Provide complete and accurate information when requested.
3.2 Bookings:
• Only individuals 18+ may book.
• Bookings on behalf of others are permitted; the lead booker is responsible for all payments.
• Some Services may be unsuitable for certain individuals. Contact us with any concerns.
3.3 You are responsible for safeguarding personal belongings throughout the Services.
3.4 We accept no liability for incorrect information provided by you.
3.5 If you cause delay or prevent us from fulfilling obligations:
• We may suspend Services until resolved;
• We are not liable for resulting costs/losses;
• You must reimburse us for costs/losses.

4 CHARGES AND PAYMENT
4.1 Prices may change at any time. If changes occur after confirmation, you can accept the new price or cancel (excluding platform/processing fees).
4.2 We reserve the right to correct pricing errors. If an error is discovered after confirmation, you may accept the correct price or cancel.
4.3 Payments may be processed by the Platform Provider or its payment agent.
4.4 Final balances must be paid by the stated deadline. Non-payment may result in cancellation and fees.
4.5 Currency conversions are based on exchange rates at the time of payment. Additional exchange fees may apply.
4.6 Local taxes (e.g., tourist tax) may apply and are your responsibility.
4.7 Prices exclude insurance, travel, visas, baggage fees, personal expenses, excursions, and more unless expressly included.
4.8 Overdue payments may incur 5% annual interest.
4.9 Fraudulent payments will result in cancellation and liability for resulting expenses.

5 INTELLECTUAL PROPERTY RIGHTS
5.1 All IP rights remain vested in the Supplier.
5.2 Website content is for personal, non-commercial use only. Reproduction is prohibited.

6 TRAVEL INFORMATION AND INSURANCE
6.1 You are responsible for passport, visa, and health requirements.
6.2 Ensure all required documents are in order prior to travel.
6.3 You are strongly encouraged to have adequate insurance for all activities and potential incidents.

7 CANCELLATION BY THE SUPPLIER
7.1 We may cancel a Service with notice. If so, you may be offered an alternative or a refund (minus fees).
7.2 All refunds are less any incurred platform, transaction, and processing fees.

8 CHANGE OF BOOKING BY THE SUPPLIER
8.1 We may make changes. Minor changes do not require notice.
8.2 Significant changes will be communicated. You may: (a) Accept the change; (b) Reject and receive a refund (minus fees); (c) Switch to an alternative (price difference may apply).
8.3 Venue, event, or time changes are not considered significant.

9 UNAVOIDABLE AND EXTRAORDINARY CIRCUMSTANCES
9.1 We are not liable for delays or non-performance due to circumstances beyond our control.
9.2 These include, but are not limited to: strikes, power failure, war, pandemics, government restrictions, natural disasters, etc.
9.3 Ensure you have insurance that covers such events.

10 LIMITATION OF LIABILITY
10.1 Nothing excludes liability where unlawful to do so. Your statutory rights are unaffected.
10.2 We are not liable for losses, except in cases of negligence causing death, injury, or fraud.
10.3 Claims must be raised in writing within 30 days of the end of your trip.

11 ACCESS TO WEBSITE
11.1 We may suspend or terminate access to the Website at our discretion.

12 GENERAL
12.1 We may transfer rights and obligations to another organisation.
12.2 Terms may be amended at any time. Check for updates regularly.
12.3 Failure to enforce terms immediately does not waive our rights.
12.4 If any term is deemed unlawful, the rest remain valid.
12.5 These terms are governed by Cyprus law. Cypriot courts have exclusive jurisdiction.

13 THIRD-PARTY ACTIVITIES AND PARTICIPANT RESPONSIBILITY
13.1 Independent Activity Providers Activities are delivered by third-party organisers. Responsibility rests solely with the Activity Provider and the ticket holder.
13.2 Ticket Holder Responsibility and Acknowledgement of Risk Ticket holders accept full responsibility for their conduct and safety. We accept no liability for:
• Late arrival or failure to locate an activity;
• Lost, damaged, or stolen items;
• Changes or cancellations by Activity Providers;
• Getting lost or disoriented;
• Any personal decisions or inactions. This list is non-exhaustive. Responsibility remains with the ticket holder for all incidents.
13.3 Release of Liability By purchasing a ticket, you release us from all claims, liabilities, or losses arising from third-party activities, including physical harm, theft, property loss, or missed events.

14 ACCESSIBILITY
14.1 Venue Accessibility Disclaimer
Back2Napa is a multi-venue festival hosted at third-party locations, including but not limited to nightclubs, boat cruises, beach venues, and other external spaces. Each venue operates independently and is responsible for its own accessibility provisions.
14.2 No Guarantee of Accessibility
While some venues may have features to support individuals with mobility or accessibility requirements, we cannot guarantee that all venues, events, or routes between them will be accessible. The overall festival experience may not be suitable for individuals with specific accessibility needs, including those with reduced mobility, visual or hearing impairments, or other requirements.
14.3 Carers and Companions
Where an attendee requires a carer or personal assistant to accompany them for medical or accessibility reasons, the carer must present valid identification and documentation upon arrival. If a guest is unable to participate in the event without a carer present, and the carer fails to provide valid documentation or is not present at the time of entry, we reserve the right to refuse entry to both the guest and the carer. No exceptions or refunds will be issued in such cases.
14.4 No Liability for Venue Limitations
We are not liable for any lack of accessibility at individual venues or for any impact this may have on a participant’s ability to attend or enjoy certain parts of the festival. All accessibility policies and facilities are the responsibility of the individual venue or provider.

If you have specific accessibility needs, you are advised to contact us prior to booking so we can provide as much information as possible. However, we make no assurances regarding the suitability of any venue or event for accessibility requirements.
